Acceptance of Terms
By accessing or using Best in Phoenix, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.
We reserve the right to update these terms at any time. Continued use of the platform after changes are posted constitutes your acceptance of the revised terms.
Description of Service
Best in Phoenix is a community-powered platform that provides the following services:
A searchable directory of local businesses in the Phoenix metropolitan area.
Community voting polls to recognize the best local businesses across various categories.
User-submitted reviews and ratings for listed businesses.
Business claim and verification tools for business owners.
A rewards program that credits points for engagement activities such as voting, reviewing, and referring friends.
Giveaway contests where users can spend earned points for entry.
Eligibility
You must be at least 18 years of age to create an account on Best in Phoenix.
Users between the ages of 13 and 17 may browse the platform and view business listings with parental or guardian consent, but may not create accounts, submit reviews, or participate in the rewards program.
The platform is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13.
User Accounts
Creating an account is optional. Many features, including browsing, voting, and reacting to businesses, are available without an account. However, an account is required to earn rewards points, enter giveaways, and sync your activity across devices.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately at legal@bestinphoenix.com if you become aware of any unauthorized use of your account.
User Content
When you submit content to Best in Phoenix — including reviews, votes, business listings, poll suggestions, and claims — you grant us a non-exclusive, royalty-free, worldwide license to display, reproduce, and use that content on the platform and in promotional materials.
You represent that any content you submit is accurate, does not violate the rights of any third party, and does not contain defamatory, abusive, or otherwise objectionable material.
We reserve the right to remove or modify any user-submitted content at our discretion, including content that violates these terms or is deemed inappropriate.
Business Listings
Business listings on Best in Phoenix are created through community submissions and public data sources. We make reasonable efforts to ensure accuracy but do not guarantee the completeness or correctness of any listing.
Business owners may claim and update their listings through our claim process. Claiming a listing requires email verification to confirm authorization.
We reserve the right to remove, modify, or decline any business listing at our discretion.
Voting and Polls
Community polls allow users to vote for their favorite businesses. Each person is limited to one vote per poll to ensure fairness.
We use technical measures including CAPTCHA verification and voter identifiers to prevent abuse. Any attempt to manipulate voting results may result in vote removal and potential account restrictions.
Poll results and "Best in Phoenix" designations are based on community votes and do not constitute an endorsement by Best in Phoenix.
Community Suggestions
Users may suggest businesses for inclusion in community polls. Suggestions may be upvoted by other users to indicate community interest.
Submitting a suggestion does not guarantee inclusion in any poll. We reserve the right to use, modify, or decline suggestions at our discretion.
By submitting suggestions, you grant Best in Phoenix the right to use the suggestion content without compensation.
Prohibited Conduct
You agree not to engage in any of the following prohibited activities:
Submitting false, misleading, or fraudulent business information, reviews, or claims.
Spamming, including submitting duplicate or automated submissions.
Impersonating any person or entity, or misrepresenting your affiliation with a person or entity.
Using automated tools, bots, scrapers, or other software to access, collect, or interact with the platform without our express written permission.
Interfering with or disrupting the platform, servers, or networks connected to the platform.
Attempting to manipulate poll results, review scores, or engagement metrics through coordinated or fraudulent activity.
Using the platform for any illegal purpose or in violation of applicable laws.
Intellectual Property
The Best in Phoenix name, logo, design, and original content are the property of Best in Phoenix and are protected by applicable intellectual property laws.
You may not use our branding, trademarks, or original content without prior written permission.
Third-Party Links and Services
Best in Phoenix may contain links to third-party websites and services, including business websites, partner platforms (such as Deposyt), mapping services (such as Google Maps), and social media platforms.
We are not responsible for the content, privacy practices, or availability of any third-party websites or services. Your interactions with third-party services are governed by their own terms and policies.
Disclaimers
Best in Phoenix is provided "as is" and "as available" without warranties of any kind, either express or implied.
We do not endorse, guarantee, or assume responsibility for any business listed on the platform. Your interactions with businesses found through our platform are solely between you and the business.
We are not responsible for the accuracy of user-submitted content, including reviews, ratings, and business information.
Limitation of Liability
To the fullest extent permitted by law, Best in Phoenix shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.
Our total liability for any claim arising from your use of the platform shall not exceed the amount you paid to us, if any, during the twelve months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless Best in Phoenix, its owners, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the platform, your violation of these terms, or your violation of any rights of another party.
Termination
We reserve the right to suspend or terminate your account and access to the platform at our sole discretion, without prior notice, for conduct that we determine violates these terms or is otherwise harmful to the platform or other users.
Upon termination, your right to use the platform will immediately cease. Any content you have submitted may remain on the platform in accordance with our data retention practices.
You may delete your account at any time by contacting us at legal@bestinphoenix.com.
Governing Law and Disputes
These Terms of Service are governed by the laws of the State of Arizona, without regard to its conflict of law provisions.
Any disputes arising from these terms or your use of the platform shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. You consent to the personal jurisdiction of such courts.
Changes to Terms
We may update these Terms of Service from time to time. We will notify you of any material changes by posting the updated terms on this page with a new "Last Updated" date.
Your continued use of Best in Phoenix after changes are posted constitutes your acceptance of the revised terms.
BIP Rewards Program
Best in Phoenix operates a points-based loyalty program called "BIP Rewards" (the "Rewards Program"). No purchase is necessary to participate in the Rewards Program. Participation is entirely free and voluntary.
Eligibility
To participate in the Rewards Program, you must: (a) be at least 18 years of age; (b) be a legal resident of the United States; and (c) have a registered account on the Site in good standing.
Earning Points
You may earn points through qualifying actions on the Site, including but not limited to: voting in polls, writing reviews, adding favorites, reacting to content, nominating businesses, referring new users, and creating an account. Points are subject to daily earning caps, which may vary by action type and are disclosed on the Rewards Program pages.
Points Have No Cash Value
Points earned through the Rewards Program have no cash value, monetary equivalent, or property value. Points are not transferable between accounts, and may not be sold, bartered, exchanged, or otherwise transferred to any other person or entity. Points may only be redeemed as described within the Rewards Program (e.g., entering giveaways).
Levels & Multipliers
The Rewards Program includes tiered levels (Explorer, Local, and Phoenix Pro) based on cumulative points earned. Higher levels may provide point multipliers or cosmetic recognition on the Site. Levels represent cosmetic status only and do not guarantee any specific benefits, prizes, or privileges.
Streaks
You may earn bonus points for consecutive days of qualifying activity on the Site ("Streaks"). Streaks reset to zero if you miss a calendar day of qualifying activity. Streak bonuses are subject to change.
Badges
You may earn achievement badges for completing specific milestones or actions within the Rewards Program. Badges are cosmetic recognition only and carry no monetary value.
Right to Modify or Cancel
We reserve the right, at our sole discretion, to modify, suspend, or terminate the Rewards Program, or any part thereof, at any time and with or without notice. This includes the right to change point values, daily caps, level thresholds, multipliers, badge criteria, or any other aspect of the program. Accumulated points have no vested value and may be adjusted or forfeited in connection with any program modification or termination.
Abuse & Fraud
We reserve the right to revoke points, reset levels, suspend accounts, or permanently ban users who engage in any form of abuse, fraud, or manipulation of the Rewards Program. This includes, but is not limited to: use of bots or automated tools, creation of fake or duplicate accounts, submission of fake reviews, self-referrals, coordinated manipulation, or any other activity that we determine, in our sole discretion, undermines the integrity of the program.
Giveaways & Sweepstakes
Best in Phoenix may offer promotional giveaways and sweepstakes from time to time (each, a "Giveaway"). The following terms apply to all Giveaways unless specific Giveaway rules state otherwise.
No Purchase Necessary
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN ANY GIVEAWAY. A purchase or payment will not increase your chances of winning.
Alternative Method of Entry (AMOE)
Free entry into any Giveaway is available by sending an email to hello@bestinphoenix.com with the subject line "Giveaway Entry" and including your full name and the name of the Giveaway you wish to enter. Emails must be received during the applicable entry period. Alternative method of entry ("AMOE") entries will receive weight equal to the minimum point entry for that Giveaway and will be treated equally in the drawing.
Eligibility
Giveaways are open to legal residents of the United States who are at least 18 years of age at the time of entry. Giveaways are void where prohibited by law. Employees of Best in Phoenix LLC and their immediate family members are not eligible.
Entry Period
Each Giveaway has a defined entry period with specific start and end dates, which are displayed on the applicable Giveaway page on the Site. Entries received outside the entry period will not be accepted.
Winner Selection
Winners are selected by weighted random drawing based on the number of points spent on entries. AMOE entries receive weight equal to the minimum point entry for that Giveaway. The odds of winning depend on the total number and weight of entries received for each Giveaway.
Prizes
Prize details are described on each Giveaway page. No substitution, transfer, or cash equivalent of prizes is permitted, except at the sole discretion of the sponsor. All prizes are awarded "as is" without warranty of any kind.
Winner Notification
Winners will be notified via the email address associated with their account within seven (7) days of the drawing. Winners must respond within fourteen (14) days of notification to claim their prize. If a winner does not respond within the 14-day period, the prize will be forfeited and an alternate winner may be selected.
Tax Responsibility
Winners are solely responsible for all federal, state, and local taxes associated with their prize. For prizes valued at $600 or more, winners will be required to provide a completed IRS Form W-9, and Best in Phoenix will issue a Form 1099-MISC as required by law.
Business-Sponsored Giveaways
Some Giveaways may be sponsored by local businesses. The sponsor of each Giveaway is identified on the applicable Giveaway page. Best in Phoenix LLC is the default sponsor unless otherwise stated. Best in Phoenix administers the drawing and winner selection for all Giveaways regardless of sponsor.
Limitation of Liability
Best in Phoenix and any Giveaway sponsors are not responsible for: (a) lost, late, misdirected, garbled, or incomplete entries; (b) technical failures, including hardware or software malfunctions, lost or unavailable network connections, or failed electronic communications; (c) any injury or damage to persons or property arising from participation in a Giveaway or acceptance or use of a prize; or (d) any printing, typographical, or other errors in Giveaway materials.
Governing Law
All Giveaways are governed by the laws of the State of Arizona, as set forth in the Governing Law and Disputes section of these Terms. Any disputes relating to a Giveaway shall be resolved in accordance with that section.
Referral Program
The BIP Rewards Referral Program allows registered users to earn points by referring new users to the Site.
How It Works
Each registered user receives a unique referral link. When a new user creates an account using your referral link and completes their first qualifying action on the Site, you (the referrer) earn referral points. The number of points awarded per successful referral is subject to change at our discretion.
Daily Cap
Referral points are subject to a daily maximum. Once you reach the daily cap, additional referrals on that calendar day will not earn points until the following day.
Prohibited Conduct
The following activities are strictly prohibited: Self-referrals (referring yourself using alternate accounts or email addresses). Creating fake or fraudulent accounts to generate referral points. Distributing referral links via spam, unsolicited messages, or bulk email. Purchasing traffic or using paid advertising to drive referral signups without our written consent. Offering financial incentives or rewards to others in exchange for signing up via your referral link.
Right to Revoke
If we determine, in our sole discretion, that referral points were earned through fraudulent or prohibited means, we reserve the right to revoke those points, reverse any associated rewards, and suspend or permanently ban the offending account.
